HOW DO WE PROTECT YOUR INFORMATION?
We implement a variety of security measures to maintain the safety of your personal information when you place an order or enter, submit, or access your personal information.

All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway providers database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential.

We reserve the right to change this User Agreement from time to time without notice. You acknowledge and agree that it is your responsibility to review this User Agreement periodically to familiarize yourself with any modifications. Your continued use of this site after such modifications will constitute acknowledgment and agreement of the modified terms and conditions.
RESPONSIBLE USE AND CONDUCT
By visiting our website and accessing the information, resources, services, products, and tools we provide for you, either directly or indirectly (hereafter referred to as ‘Resources’), you agree to use these Resources only for the purposes intended as permitted by (a) the terms of this User Agreement, and (b) applicable laws, regulations and generally accepted online practices or guidelines.
Accordingly, you understand that:
- In order to access our Resources, you may be required to provide certain information about yourself (such as identification, contact details, etc.) as part of the registration process, or as part of your ability to use the Resources. You agree that any information you provide will always be accurate, correct, and up to date.

- Accessing (or attempting to access) any of our Resources by any means other than through the means we provide, is strictly prohibited. You specifically agree not to access (or attempt to access) any of our Resources through any automated, unethical or unconventional means.
- Engaging in any activity that disrupts or interferes with our Resources, including the servers and/or networks to which our Resources are located or connected, is strictly prohibited.

We are not responsible for any delay or failure in removing such content. If you post content that we choose to remove, you hereby consent to such removal, and consent to waive any claim against us.
- You agree to indemnify and hold harmless Paragon Expeditions LLC and its owners and affiliates, and their directors, officers, managers, employees, donors, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this User Agreement or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this User Agreement. In such event, you shall provide us with such cooperation as is reasonably requested by us.
LIMITATION OF WARRANTIES
By using our website, you understand and agree that all Resources we provide are “as is” and “as available”. This means that we do not represent or warrant to you that:
- the use of our Resources will meet your needs or requirements.
- the use of our Resources will be uninterrupted, timely, secure or free from errors.
- the information obtained by using our Resources will be accurate or reliable, and
- any defects in the operation or functionality of any Resources we provide will be repaired or corrected.
Furthermore, you understand and agree that:
- any content downloaded or otherwise obtained through the use of our Resources is done at your own discretion and risk, and that you are solely responsible for any damage to your computer or other devices for any loss of data that may result from the download of such content; and

LIMITATION OF LIABILITY
In conjunction with the Limitation of Warranties as explained above, you expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for use of products and/or services. Paragon Expeditions LLC will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using our Resources, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.
All content and materials available on http://paragonexpeditions.com, including but not limited to text, graphics, website name, code, images and logos are the intellectual property of Paragon Expeditions LLC, and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site is strictly prohibited, unless specifically authorized by Paragon Expeditions LLC.
TERMINATION OF USE
You agree that we may, at our sole discretion, suspend or terminate your access to all or part of our website and Resources with or without notice and for any reason, including, without limitation, breach of this User Agreement. Any suspected illegal, fraudulent or abusive activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities. Upon suspension or termination, your right to use the Resources we provide will immediately cease, and we reserve the right to remove or delete any information that you may have on file with us, including any account or login information.
This website is controlled by Paragon Expeditions LLC from our offices located in the State of TX, USA. It can be accessed by most countries around the world. As each country has laws that may differ from those of Texas, by accessing our website, you agree that the statutes and laws of Texas, without regard to the conflict of laws and the United Nations Convention on the International Sales of Goods, will apply to all matters relating to the use of this website and the purchase of any products or services through this site.
Furthermore, any action to enforce this User Agreement shall be brought in the federal or state courts located in Texas You hereby agree to personal jurisdiction by such courts, and waive any jurisdictional, venue, or inconvenient forum objections to such courts.
UNLESS OTHERWISE EXPRESSED, PARAGON EXPEDITIONS LLC EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

Terms and Conditions of Travel
This Agreement of Terms and Conditions (the “Agreement”), including the Statement of Responsibilities, is made between you (the “Traveler”) and Paragon Expeditions, LLC, a Texas limited liability company (“Paragon”), and effective as of the date of signature below. The Agreement is intended to outline, define and limit the respective roles and responsibilities of the various parties and entities involved in the Paragon trips, vacations and expeditions (the “Travel”) selected, reserved and purchased by the Traveler. Please read carefully, as the Agreement is intended to be a legally binding document, including an acceptance and waiver of liabilities as set forth below.
PARTIES INVOLVED IN THE TRAVEL
Paragon will locate and make available outstanding and unique Travel opportunities as described on its website and in its published promotional materials. Paragon will contract with qualified professional “Tour Operators” to organize and administer the trips and expeditions. The Tour Operators act as authorized agents for the “Services Suppliers” (including transportation carriers, hotels, ground operators or other suppliers of travel services connected with the Travel), who are solely responsible and liable for providing their respective travel related services to the Traveler.
STATEMENT OF RESPONSIBILITIES
Limitations by Transportation Carriers
The tariffs and passenger tickets in use by the Service Suppliers transportation carriers shall constitute the sole contract between those transportation carriers and the passenger. The carriers are not responsible for any act, omission, or event during the time that Travel participants are not aboard the carriers’ conveyances.
Waivers and Hold Harmless by Traveler
Paragon and its designated Tour Operators and administrators shall not be held liable for any damage to or loss of property, or injury to or death of persons, occasioned directly or indirectly by an act or omission of any other party or Services Supplier, including but not limited to any defect in any aircraft, watercraft or vehicle operated or provided by such other Supplier or provider, nor shall Paragon or its designated Tour Operators and administrators be held liable for any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, labor strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause beyond their control. As partial consideration for the Travel experience to be provided by Paragon, the Traveler assumes such risks and waives any claim against Paragon or its designated Tour Operators and administrators for any such loss, damage, injury or death.
Traveler Conditions and Protections
By making a reservation for Travel with Paragon, each Traveler certifies that he or she does not have any mental, physical or other condition or disability that would constitute or create a hazard for the Traveler or other Travel participants. Paragon and its Tour Operators reserve the right in their sole discretion to accept, decline to accept, or remove any participant from or on any Travel at any time. Paragon and each respective Tour Operator reserve the right, without limitation or penalty, to make changes in the published itinerary of the Travel whenever, in their sole judgment and discretion, existing conditions warrant or if they deem it necessary or desirable for the comfort, convenience or safety of Traveler or other Travel participants.
Travel Risks and Insurance
Neither Paragon, its Tour Operators nor their administrators shall be liable for any transportation carrier’s cancellation penalty incurred by the purchase by the Traveler of a restricted or nonrefundable ticket to or from the host city for the selected Travel. Baggage and personal effects are at all times the sole responsibility of the Traveler. Paragon recommends that each Traveler purchase appropriate insurance coverages, whenever available, for such risks.
Double & Single Occupancy
All quoted prices for the Travel are based on two persons sharing a room or cabin. A limited number of sole occupancy rooms or cabins may sometimes be available for purchase at a higher price, on a “first come, first served” basis. A single Traveler requesting assistance from Paragon in matching up with a roommate to avoid single occupancy charges will be accommodated when possible.
All prices and fares are quoted in U.S. dollars, based on current tariffs and rates of Services Suppliers at existing currency exchange rates, and are subject to change due to unforeseen circumstances. While Paragon will strive to maintain the listed and quoted prices, it reserves the right to levy a surcharge in the event of unforeseen circumstances or unanticipated events, and notification will be given at the time of final invoicing.
Lodging and meals – breakfast (B), lunch (L) and dinner (D) – during the Travel, as may be indicated in the Paragon promotional materials (but not on Traveler’s flights to/from the Travel host city); pre-departure and informative materials about the Travel; entrance fees, excursions and sightseeing noted as “included” in the Travel description; gratuities and tips except those for train or ship’s crew; ground transportation during the Travel as indicated in the description; transfers to and from group flights or group bookings; services of guides and Paragon staff; and taxes, port charges, baggage handling and service charges.
Costs Not Included
Air transportation and related fees, except as indicated in the Travel itinerary; activities noted as “optional” in the itinerary; gratuities and tips for train or ship’s crew; Traveler’s passport and visa expenses; insurance for baggage, accidents or trip cancellation; personal expenses, such as laundry, telephone calls and snacks/beverages; and any other items not specifically noted as “included” in the Travel description.
PAYMENTS, CANCELLATIONS, AND REFUNDS
To confirm a Travel reservation online, a $500 advance payment (the “Deposit”) for each reserving Traveler is required by credit card or debit card. Final payment for the full Travel cost is due no later than 90 days prior to departure by check, credit card or debit card. Reservations may be canceled by Paragon if full payment has not been received by 90 days prior to departure. For reservations made within 90 days of the departure date, full payment is required when the reservation is confirmed.
Cancellations and Refunds
A cancellation notice from a Traveler must be made in writing (by fax, email or postal mail) and will be effective as of the date of receipt by Paragon. If you cancel 120 days or more prior to departure, a full refund will be made. Charges or deductions for cancellations that occur less than 120 days prior to departure (the “Cancellation Penalty Period”) are as follows: the full amount of your booking Deposit if during 91-119 days prior to departure; 50% of the full Travel cost if during 45-90 days prior to departure; and 100% of the full Travel cost if 44 days or less prior to departure. Any revisions made by Paragon within the Cancellation Penalty Period, such as a change in departure date or choice of trip, are subject to this cancellation policy. Any airline tickets obtained by Traveler, either directly or through Paragon, are subject to the carrier’s contractual refund policy. Leaving a Paragon trip in progress, for any reason whatsoever, will not result in a refund, and no refunds will be made for any unused portions of a trip if Traveler leaves. Paragon reserves the right to cancel any trip because of inadequate enrollment that would make the trip economically infeasible to operate or because of good-faith concerns, in Paragon’s sole discretion, with respect to the safety, health or welfare of Travelers. If a trip is cancelled prior to departure, a full refund or credit toward future Travel opportunities with Paragon will be offered to Traveler. If Paragon cancels a trip in progress, Traveler will receive a prorated refund based on the number of days not completed on the trip. Paragon will not be responsible for obtaining or reimbursing Traveler for nonrefundable airline tickets or for any airline tickets purchased by Traveler directly from an airline or travel agent. Traveler’s purchase of trip cancellation insurance is strongly recommended.
The itineraries and Travel information presented by Paragon are subject to modification and change by Paragon or its designated Tour Operator. Every reasonable effort will be made to operate programs as planned, but alterations may still occur at any time, including after final itineraries are sent.
Each Traveler must be in good physical and mental health to travel. Any physical condition, diet or treatment requiring special attention must be reported in writing to Paragon when the reservation is made. Paragon will make reasonable efforts to accommodate such disclosed condition or circumstances, but neither Paragon nor its Tour Operator will not assume any risk of harm or injury to Traveler or other Travel participants arising therefrom.
Photography, Use of Images
Paragon reserves the right to take photographs or videos during the operation of any part of the Travel and to utilize the resulting images or recordings for promotional or commercial use. By making a reservation, each Traveler consents and agrees to allow his or her likeness to be used by Paragon, its authorized third parties and the Tour Operator without compensation to the Traveler and without further notification or consent. If a Traveler prefers that his or her image not be used, the Traveler must notify Paragon prior to departure on the Travel. Copyright to all photographs, video and related materials created by the Traveler shall belong to the Traveler upon creation, and the Traveler grants to Paragon or the Tour Operator permission and a non-exclusive irrevocable license to use any such materials provided by Traveler to Paragon or the Tour Operator in any media for the promotion of Paragon and its future Travel opportunities.
Other Terms and Conditions or limitations may apply to some Travel or portions of the Travel, and information about such will be provided by Paragon to the Traveler as a pre-Travel communication. By making a reservation for the Travel, each Traveler specifically agrees to the above Terms and Conditions, including the Statement of Responsibility. Paragon’s acceptance and booking of Traveler’s reservation is conditioned upon Traveler’s consent and acceptance of the Terms and Conditions, which will be evidenced by Traveler’s signature upon a copy of this document. A faxed or emailed image of the original signed Agreement will serve as the equivalent of an original for all purposes.
